After two years, a legal battle with Victory Records and the untimely death of guitarist Casey Calvert, Hawthorne Heights are ready to release their third full-length.



Surprisingly, the album will be released August 5 via Victory, which Hawthorne Heights sued in 2006 for breach of contract, infringement and abuse. In May 2007, the judge ruled that the band was bound by contract to release two more records on Victory but was entitled to record albums that could be released elsewhere.

After the ruling, the band spoke with Rolling Stone about HH's plans. "We want to be able to release a record however we want. We had sort of been misguided a little bit at the beginning of that whole process. I think if we knew then what we know now, we may not have even filed a lawsuit to begin with," drummer Eron Bucciarelli explained.

A track list for the album has yet to be revealed, although the band recently revealed that it had recorded a song in honor of Calvert, who was found dead in November 2007 after an accidental drug overdose. The band debuted the track during its recent appearance at Bamboozle Left. Bucciarelli has also said that some of Calvert's vocals might appear on the new record.
